1. Are there any unregistered encumbrances?

This includes any encumbrance not registered on title that will continue to affect the property after settlement, such as a private lease, informal occupation, an unregistered commercial lease, or permission for someone to use part of the land.

2. Is there any written or verbal agreement allowing another person to use the property?

This includes use of the whole property or part of the property that will still apply after settlement.

Tenancies, Notices & Pool

3. Is there a Residential Tenancy or Rooming Accommodation Agreement in place, or has there been one in the past 12 months?

4. Are there any unsatisfied show cause notices, enforcement notices, orders or authority notices?

This includes any notice or order from council, state government, court, or another authority that is still in effect and relates to required works or monetary obligations.

5. Is there a pool or spa on the property?
